In the dispute over a takeover of Twitter, high-tech billionaire Elon Musk has responded with a counterclaim against the short message service. Musk filed the lawsuit as "confidential" in the Delaware state court. This means: Musk's lawsuit cannot be viewed. Twitter had also sued the founder of the electric car manufacturer Tesla in Delaware, and the judge responsible had set the trial to start on October 17 shortly beforehand.

The company and Musk are arguing about the planned acquisition of Twitter for a price of 44 billion dollars (around 43 billion euros). Musk announced on July 8 that he no longer wanted to buy Twitter – because of allegedly “false and misleading” information from Twitter. In particular, Musk accuses the social media platform of having too few spam and fake accounts on the platform.
Twitter described this justification as "hypocrisy" and wants to take legal action to force Musk to complete the contractually agreed purchase. Five days of negotiations are scheduled for the process.

Observers consider a judicial defeat for Musk and thus also a forced fulfillment of the takeover agreement to be quite conceivable. It is also possible that Musk would have to pay Twitter a contractual penalty. According to the takeover agreement, this amounts to up to one billion dollars.
